Do You Need a Fence Permit? Rules by Town Near Fuquay-Varina

Quick answer: It depends on the town or county that covers your lot, not your mailing address. Fuquay-Varina and Holly Springs say a fence does not need a permit. Angier requires a land use permit inside town limits. Garner requires a zoning compliance permit for certain home fences. Harnett County does not regulate fences on home lots outside its towns. Every place still has height limits, easement rules, and maybe an HOA. This is homeowner information, not legal advice, so check your own lot before you build.

How do I know which rules cover my lot?

Your mailing address can fool you. Fuquay-Varina's zip code, 27526, reaches well past town limits, and part of it is in Harnett County. A "Willow Spring" address can be in Wake County or Johnston County.

Start with the parcel. In Wake County, the iMAPS property search shows a "Jurisdiction" line that names the office in charge. Your tax bill and your plat help too. A plat is the recorded map of your lot, and it shows property lines and easements.

Fuquay-Varina

The Town's fence FAQ says a permit is not required for a fence in the corporate limits or the ETJ. The ETJ is the area just outside town limits that still follows Town zoning. Pools, sheds, and detached garages do need permits.

The Town's Land Development Ordinance caps a front yard fence at 4 feet and bans solid fences there. Inside town limits, side and back yard fences can be up to 6 feet. In the ETJ, the Town sets no maximum for side and back yards. Our fence height limits guide and Fuquay-Varina permit guide go deeper.

Holly Springs

The Town of Holly Springs fence page says the Town does not require a permit for fences. A front yard fence can be up to 4 feet, and side and rear yard fences can be up to 6 feet. Fences can't go in the street right-of-way or in public easements, such as greenway, utility, water, sewer, or drainage easements. Our Holly Springs area page covers corner lots and who to call.

Angier

Angier is different. The fence section of the Town's ordinance says a land use permit is required to install a fence within the corporate limits. The Town's Planning and Permitting page lists fences among the projects that need a Land Use Permit. Front yard fences can be up to 4 feet and side and rear yard fences up to 6 feet. A taller fence on a home lot needs a special use permit from the Board of Adjustment. Our Angier area page has the easement and floodplain rules, with sources.

Garner

The Town of Garner fence page says an approved Zoning Compliance Permit is required before building certain residential fences and walls. The Town asks you to contact Planning before you apply. In home districts, open and solid fences can be up to 4 feet in front and corner side yards. Solid fences can be up to 6 feet in side and rear yards, and open fences can be any structurally sound height there. Our Garner area page covers easements and pools.

Unincorporated Harnett County

If your lot is in Harnett County and outside any town, Harnett County Planning says the county does not regulate fences on residential lots, and no fence permit is required. A fence still cannot sit in an easement or right-of-way, and it must stay outside the NCDOT 10-foot by 70-foot sight triangle. The county recommends building about 1 foot inside your property line.

Willow Spring and unincorporated Wake or Johnston County

Willow Spring is not its own town, so the county rules decide. Johnston County's building permit page lists fences among projects that do not need a building permit. In unincorporated Wake County, check the county's ordinance or call Wake County Planning. Our Willow Spring fence rules guide walks through both counties.

What applies everywhere?

  • Call 811 first. North Carolina law says the person digging must give notice at least three full working days before the dig (G.S. 87-122). Call 811 or use NC 811.
  • Check for an HOA. HOA rules can be stricter than the town's. Get written approval before anyone digs. We can't approve a fence for your HOA or promise that your HOA will. Our HOA fence approval guide shows the steps.
  • Pools are separate. A pool barrier follows North Carolina's pool code, not these yard heights. See our aluminum and pool fence page.
