Fence Height Limits in Fuquay-Varina

Quick answer: Fence height in Fuquay-Varina depends on the yard and on where the lot sits. Inside town limits, a front yard fence can be up to 4 feet, and it cannot be solid. A side or back yard fence can be up to 6 feet. In the Fuquay-Varina ETJ, the side and back yard have no Town height cap, while the front yard rule is still written as 4 feet. This is homeowner information, not legal advice. Confirm your lot with the Town of Fuquay-Varina Planning Department at (919) 552-1429 before you build.

A Fuquay-Varina mailing address does not tell you which rules cover the yard. Our area page explains why two homes in the same zip can differ, and our fence permit guide plus our fence FAQ cover the Town's no-permit rule for town limits and the ETJ.

What is the front yard fence height in Fuquay-Varina, NC?

The Town's Land Development Ordinance is the rule book for fences, and section 9-1303 says a front yard fence cannot be taller than 4 feet. That limit runs along the front property line, or the right-of-way, and along the side lines up to the front wall of the house. The Town posts the current book, amended May 4, 2026, on its document downloads page, and the fence wording is on this page.

The same sentence bans opaque fences in the front yard. Opaque means you cannot see through the fence, so a solid panel stays behind the front wall of the house, while a low open fence can sit out front if it is 4 feet or under. That front yard sentence is not split between town limits and the ETJ the way the side and back sentence is, so ask Planning how it applies if you are in the ETJ.

How tall can a side or back yard fence be?

Inside town limits, a side or back yard fence can be up to 6 feet. That part of the yard starts at the front wall of the house and runs to the back property line. In the ETJ, the same section says there is no maximum fence height in the side or back yard.

YardInside town limitsIn the ETJ
Front yard4 ft max; no solid fences4 ft
Side and back yard6 ft maxNo Town maximum

Other websites sometimes say 8 feet is allowed in town. The Town's rule book says 6 feet inside town limits. No Town maximum in the ETJ still leaves the front yard limit, easements, the right-of-way, and your HOA in place.

What is the Fuquay-Varina ETJ, and why do people get it wrong?

ETJ means extraterritorial jurisdiction. It is land outside town limits where the Town still applies its zoning rules, so the fence rules can cover the lot even though you are not inside the town.

A Fuquay-Varina street address is not proof you are inside town limits, because zip code 27526 includes town limits, the ETJ, and land outside both. "No maximum" does not mean any height is fine, and the county has not taken over a lot that sits in the ETJ. If the lot is outside both, the Town's answer may not apply.

The Town's fence FAQ says a permit is not required in the corporate limits or the ETJ, while Town standards stay mandatory even when a neighborhood has its own rules. Pools, sheds, and detached garages do need permits. To see which office covers your lot, use the jurisdiction line on Wake County iMAPS, as our area page explains, or call the Town of Fuquay-Varina Planning Department at (919) 552-1429. That number is the Town's, from the same FAQ page and from its site plan checklist, and it is not our business line.

What about corner lots and sight triangles?

The fence section does not print a separate corner-lot height. The 4-foot front yard limit still follows the side lines up to the front wall of the house, and a corner lot also has a side along a second street, where a tall solid fence can block a driver's view.

Section 9-1617 points sight distance to the Town's street specs instead of listing one fence height. Page 61 says a hedge, tree, or shrub between the building setback and the street cannot block the site triangle at a street intersection. The street specs say a sight triangle applies at street intersections, and that shrubs and ground cover less than 42 inches tall may be allowed there. That 42-inch figure is about plants, not a fence height. The specs also say the Town can notify an owner to remove a sight-distance block on private property, so call Planning at (919) 552-1429 before you choose a height near a corner. If the road belongs to the state, ask which office sets the sight rule.

Can an HOA require a shorter fence?

Yes. The Town's fence FAQ says to check your homeowners' association or your deed, because those private rules can be stricter than the Town's, and the Town's rules still apply on top of them. We are not your HOA, so we cannot approve the fence or promise that your HOA will. Our HOA fence approval guide shows how to get a written answer before any work starts.

What else does the Town require besides height?

Section 9-1303 and the Town's fence FAQ also cover these points.

  • Finished side out. The finished surface faces the street or the neighbor, in town limits and in the ETJ.
  • A gap at the ground. Inside town limits, many fences need at least 2 inches of clearance so rainwater can pass. That gap does not apply to masonry, hedges, chain link, split rail, or the like. In the ETJ, the 2-inch gap is written for privacy fences only.
  • Easements and the street. Fences are not allowed in utility, drainage, stormwater, or similar easements, or in the public right-of-way. The right-of-way typically ends 2 feet behind the sidewalk, or 5 feet behind the curb where there is no sidewalk.
  • Landscape buffers. On a residential lot, a fence in a perimeter buffer must sit at least 8 feet from the rear or side property line.
  • Inside your line. The Town's FAQ says a fence should sit at least 3 inches inside the property line, so you avoid a boundary dispute.
  • Materials. Inside town limits, chain link must be plastic coated or powder coated in black or green. In the ETJ, no fence material is prohibited. Chain link is prohibited in a nonresidential front yard.

For a backyard fence inside town limits, compare our wood privacy page, our vinyl fence page, and our chain link page. A pool fence follows separate safety rules, so use our aluminum and pool-code page instead of these yard heights.

Why should you call NC 811 before anyone digs?

The Town's Call Before You Dig page says North Carolina law requires notice to the utilities at least 3 working days before you dig. Call 811. North Carolina 811 alerts the utilities at no charge, and they mark their lines. Skipping the call can damage property or injure someone. The call is not a fence permit, and it does not replace your HOA. When you want a look at the line, request a free estimate or call or text (919) 276-8406.

Fence height FAQ

What is the front yard fence height in Fuquay-Varina?

It is 4 feet, up to the front wall of the house, and a solid fence is not allowed there. Confirm the lot with the Town Planning Department at (919) 552-1429.

How tall can a backyard fence be in Fuquay-Varina?

Inside town limits, side and back yard fences can be up to 6 feet, starting at the front wall of the house. In the ETJ the Town sets no maximum for those yards, and your HOA may still set a lower one.

Do corner lots have a separate fence height?

The fence section does not print one. The 4-foot front rule still runs to the front wall of the house, and sight distance is in the Town's street specs, so ask Planning before you build near a corner.

Can my HOA make the fence shorter than the Town allows?

Yes. HOA rules can be stricter, the Town's rules still apply, and you need the HOA answer in writing before work begins.
