One zip code, two counties, two sets of rules

Fuquay-Varina's zip code, 27526, covers much more land than the Town itself. The Town is in Wake County, while the southern part of the zip reaches into Harnett County.

The practical consequence catches almost everyone: your mailing address does not tell you which fence rules apply to your yard. Two neighbors with identical "Fuquay-Varina, NC 27526" addresses can be under different height limits, different school districts and different county governments.

You probably don't need a permit — but you do need your HOA

The Town's fence FAQ says a permit is not required to install a fence in Fuquay-Varina's corporate limits or ETJ (Town fence FAQ). A pool, a shed or a detached garage does need one. A fence does not.

If your home is in an HOA, you also need its written approval. The same FAQ says HOA rules or deed restrictions can be stricter, and the Town's standards still apply on top of them. We can't approve a fence for your HOA or promise that your HOA will.

Other Town fence rules

These come from the Town's fence FAQ and its Land Development Ordinance.

• Finished side faces outward, toward the street or your neighbor
• A 2-inch clearance from the bottom of most fences to grade inside town limits, for stormwater (masonry, hedges, chain link and split rail are exceptions)
• Set the fence at least 3 inches inside your property line to avoid boundary disputes
• No fences in the public right-of-way or in utility, drainage or stormwater easements; a fence in a landscape buffer on a home lot sits at least 8 feet off the rear or side line
• Chain link inside town limits must be coated in black or green

How do I know if I'm in town limits, the ETJ, or Harnett County?

Check your lot, not your mailing address. A Fuquay-Varina address can sit in three different places, and each one has its own rule-maker.

• Town limits. The Town's rules apply.
• The ETJ. This is the area outside town limits that is still subject to the Town's zoning and development standards. ETJ owners don't pay Town taxes or vote in Town elections (Town: ETJ expansion).
• Outside both. Your county sets the rules, if it sets any.

The ETJ is bigger than it used to be. Wake County approved 9,215 acres for the Town's ETJ on October 21, 2019, and the change took effect on December 20, 2019 (Town: ETJ expansion). So an older map, or a neighbor's memory of the area, may be out of date. State law now stops any town from growing its Wake County ETJ past its January 1, 2025 size, through December 31, 2028 (Session Law 2025-30, Wake County: ETJ).

Two quick ways to check. Wake County's iMAPS property search shows a "Jurisdiction" line that names the permitting agency for an address. You can also call the Town of Fuquay-Varina Planning Department at (919) 552-1429. That is the Town's number, not ours.

What if my home is on the Harnett County side of 27526?

The southern part of 27526 is in Harnett County. If the county map shows your lot in Harnett County and outside any town, Harnett County's planning office says the county does not regulate fences on residential lots, and no fence permit is required (Harnett County Planning).

That is not the same as "anything goes." Harnett County's planning office says a fence:

• cannot sit in an easement or right-of-way;
• must stay outside the NCDOT sight triangle, a 10-foot by 70-foot area;
• should ideally sit about a foot inside the property line, to avoid disputes with a neighbor.

Fences in a required landscape buffer, a manufactured home park, or a non-residential development are regulated. Neighborhood covenants and deed restrictions are a private matter there too. The county says it does not enforce them, and its planning page links to the Register of Deeds for looking up covenants and deeds.

If an address falls inside a town's limits or ETJ, that town's rules apply instead.

If I'm in the ETJ, am I "in town"?

No. The ETJ is outside town limits. Town zoning and development standards apply there, but ETJ owners don't pay Town taxes.

Where do I apply for a permit for a shed or addition in the ETJ?

At Fuquay-Varina Town Hall, not in downtown Raleigh. (A fence itself doesn't need a Town permit, as covered above on this page.)

Does Harnett County require a fence permit?

For a residential lot in Harnett County's own jurisdiction, no. The county says it does not regulate fences on residential lots. A town's limits or ETJ, an HOA, and easements can still apply.

A little local history

The town is two towns. Fuquay Springs grew up around a mineral spring a Fuquay descendant turned up while plowing a field around 1858 — the spring house still stands in Fuquay Mineral Spring Park. Varina was named for a woman who signed her letters to a Civil War soldier named Ballentine that way; he married her and named his store and post office after the signature. The two merged in 1963, and you can still walk between the two downtowns in about fifteen minutes — S. Main on the Fuquay side, Broad Street on the Varina side, where Aviator Brewing sits in the 1903 train depot.
